Welcome! These Terms of Service ("Terms") are provided by Chronicle LLC, dba Decodable Reads ("we," "us," or "our"). They govern your use of Decodable Reads, our platform for educators at decodablereads.com (the "Application"). By accessing or using Decodable Reads, you agree to comply with and be bound by these Terms. Please review them carefully.
These Terms apply only to Decodable Reads. We also operate Literacy Leap, which has its own Terms of Service at decodablereads.com/literacy-leap/tos.
Use of Services
Decodable Reads helps educators create custom decodable texts, writing activities, and lessons for their students. Educators can use Decodable Reads as individual subscribers or through an organization partner, and can give their students access to a student portal.
Content generated by Decodable Reads is intended for use in classrooms, tutoring sessions, and other instruction with your students, and may not be resold.
Accounts
Each Decodable Reads account provides access for one educator. Accounts may not be shared. If other people in your school or organization would benefit from Decodable Reads, each of them must use their own account.
You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
If your access is provided by an organization that has its own agreement with us, that agreement controls where it conflicts with these Terms.
Student Portal
If you give students access to the student portal, you are responsible for:
- Having the authorization required to enroll each student, as described in our Privacy Policy
- Sharing student usernames and classroom codes only with your own students
- Supervising your students' use of the student portal as appropriate
Students may use the student portal only with access provided by the educator who created their profile.
Subscriptions and Payment
Individual subscribers pay for Decodable Reads through our payment processor, Stripe. Educators who access Decodable Reads through an organization do not pay us directly; their organization pays for their access.
Individual subscriptions renew automatically at the end of each billing period, monthly or annually depending on the plan you chose when you signed up, until you cancel. By subscribing, you authorize us to charge your payment method for each renewal.
You can cancel at any time in the app or by emailing support@decodablereads.com. When you cancel, you keep access until the end of your current billing period, and your subscription will not renew.
Data Collection
We collect and use information as described in the Decodable Reads Privacy Policy at decodablereads.com/privacy-policy.
We may use and share aggregated or de-identified engagement and usage data to evaluate Decodable Reads and communicate its effectiveness in marketing, sales, grant, research, or public-facing materials. We do not use this permission to identify individual users, students, families, schools, or institutions without appropriate permission.
Ownership and User Rights
The Application
All features, functionality, and underlying technology of the Application, including its software, algorithms, user interface, and design elements, are the exclusive property of Chronicle LLC (doing business as Decodable Reads) or its licensors.
Generated Content
Stories, writing activities, lessons, and other content generated by the Application ("Generated Content") are provided for your use with your students. You have the right to edit, download, and use Generated Content as permitted by these Terms.
Permitted Uses
You may:
- Edit and customize Generated Content using the Application's built-in features
- Download Generated Content in PDF format or other formats provided by the Application
- Use Generated Content for personal, educational, or non-commercial purposes, including instruction with your students
Prohibited Uses
You agree not to:
- Share your account or login credentials with anyone else, or let more than one person use a single account
- Copy, modify, create derivative works of, publicly display, republish, or transmit any part of the Application itself (except Generated Content as permitted)
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
- Use any automated tools to access the Application for any purpose beyond normal use
- Attempt to gain unauthorized access to, interfere with, or disrupt the Application or its servers
- Use Generated Content for commercial purposes without explicit written permission from Chronicle LLC
Feedback
If you provide feedback, comments, or suggestions about the Application, you grant Chronicle LLC an unrestricted, perpetual, irrevocable, non-exclusive, royalty-free right to use that feedback in any manner, including to improve the Application and create other products and services.
Termination
We reserve the right to terminate or suspend your access to all or part of the Application, without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users of the Application, to us, or to third parties.
Disclaimer of Warranties
To the fullest extent permitted by law, the Application and all Generated Content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Generated Content is created using artificial intelligence and may contain errors. We do not warrant that the Application will be uninterrupted or error-free, or that Generated Content will be accurate, complete, or suitable for any particular student.
Limitation of Liability
To the fullest extent permitted by law, Chronicle LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or relating to your use of the Application. Our total liability for any claim arising out of or relating to the Application or these Terms is limited to the amount you paid us for the Application in the 12 months before the claim arose.
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, these provisions apply to the fullest extent permitted by law.
Acceptance of Terms
By accessing or using Decodable Reads, you agree to be bound by these Terms. "Using the Application" includes creating an account, logging in, generating content, editing or downloading content, creating student profiles, and interacting with any features of the Application.
If you do not agree to these Terms, you must not access or use the Application. By using the Application after being presented with these Terms, you acknowledge that you have read, understood, and agree to be bound by them.
Changes to Terms
We may revise these Terms from time to time. The most current version will always be posted on this page. If a revision is material, we will notify you via the email address associated with your account. By continuing to use the Application after revisions become effective, you agree to be bound by the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Missouri and applicable federal laws of the United States of America.
