Literacy Leap Terms of Service

Welcome! These Terms of Service ("Terms") are provided by Chronicle LLC, dba Decodable Reads ("we," "us," or "our"). They govern your use of Literacy Leap, available on the web at decodablereads.com/literacy-leap and as the Literacy Leap iOS app (the "Application"). By accessing or using Literacy Leap, you agree to comply with and be bound by these Terms. Please review them carefully.

Literacy Leap helps adults provide personalized, one-on-one reading instruction to children. You can access Literacy Leap through a participating library, your own subscription, or through an account purchased by your organization.

Content generated by Literacy Leap is intended for use with the students you support, and may not be resold.

Literacy Leap accounts are intended for adults. The adult who signs up is the account holder and is responsible for the account.

Account holders create student profiles and use Literacy Leap together with their students. Students do not use Literacy Leap on their own. Before creating a student profile, you must have the authorization required to enroll the student, as described in our Privacy Policy.

Each Literacy Leap account provides access for one adult user. Accounts may not be shared. If other adults would benefit from Literacy Leap, each of them must use their own account.

You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

If your access is provided by a library or organization that has its own agreement with us, that agreement controls where it conflicts with these Terms.

We collect and use information as described in the Literacy Leap Privacy Policy at decodablereads.com/literacy-leap/privacy-policy.

We may use and share aggregated or de-identified progress, engagement, and usage data to evaluate Literacy Leap and communicate its effectiveness in marketing, sales, grant, research, or public-facing materials. We do not use this permission to identify individual users, students, families, library patrons, libraries, or institutions without appropriate permission.

The Application

All features, functionality, and underlying technology of the Application, including its software, algorithms, user interface, and design elements, are the exclusive property of Chronicle LLC (doing business as Decodable Reads) or its licensors.

Generated Content

Stories, lesson activities, and other content generated by the Application ("Generated Content") are provided for your instructional use. You have the right to edit, download, and use Generated Content as permitted by these Terms.

You may:

• Edit and customize Generated Content using the Application's built-in features (where applicable)
• Download Generated Content in PDF format or other formats provided by the Application (where applicable)
• Use Generated Content for personal, educational, or non-commercial purposes, including instruction

You agree not to:

• Share your account or login credentials with anyone else, or let more than one adult use a single account
• Copy, modify, create derivative works of, publicly display, republish, or transmit any part of the Application itself (except Generated Content as permitted)
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
• Use any automated tools to access the Application for any purpose beyond normal use
• Attempt to gain unauthorized access to, interfere with, or disrupt the Application or its servers
• Use Generated Content for commercial purposes without explicit written permission from Chronicle LLC

Individual subscribers pay for Literacy Leap through our payment processor, Stripe, on the Literacy Leap website. Subscriptions cannot be purchased in the iOS app. Your subscription gives you access to Literacy Leap on the web and in the iOS app. Library patrons and adults who access Literacy Leap through an organization do not pay us directly.

Subscriptions renew automatically each month until you cancel. By subscribing, you authorize us to charge your payment method for each renewal.

You can cancel at any time in the app or by emailing support@decodablereads.com. When you cancel, you keep access until the end of your current billing period, and your subscription will not renew.

If you provide feedback, comments, or suggestions about the Application, you grant Chronicle LLC an unrestricted, perpetual, irrevocable, non-exclusive, royalty-free right to use that feedback in any manner, including to improve the Application and create other products and services.

We reserve the right to terminate or suspend your access to all or part of the Application, without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users of the Application, to us, or to third parties.

To the fullest extent permitted by law, the Application and all Generated Content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Generated Content is created using artificial intelligence and may contain errors. We do not warrant that the Application will be uninterrupted or error-free, or that Generated Content will be accurate, complete, or suitable for any particular student.

To the fullest extent permitted by law, Chronicle LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or relating to your use of the Application. Our total liability for any claim arising out of or relating to the Application or these Terms is limited to the amount you paid us for the Application in the 12 months before the claim arose.

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, these provisions apply to the fullest extent permitted by law.

If you use the Literacy Leap iOS app, the following also applies:

These Terms are between you and Chronicle LLC only, not Apple Inc. ("Apple"). Chronicle LLC, not Apple, is solely responsible for the iOS app and its content.

Your use of the iOS app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

Apple has no obligation to provide maintenance or support for the iOS app.

To the maximum extent permitted by law, Apple has no warranty obligation for the iOS app. Any claims, losses, or costs related to a failure of the iOS app to conform to any warranty are Chronicle LLC's responsibility.

Chronicle LLC, not Apple, is responsible for addressing any claims relating to the iOS app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.

If a third party claims that the iOS app infringes their intellectual property rights, Chronicle LLC, not Apple, is responsible for investigating, defending, settling, and resolving the claim.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with any applicable third-party terms when using the iOS app.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the iOS app.

Questions, complaints, or claims about the iOS app should be directed to Chronicle LLC using the contact information below.

By accessing or using Literacy Leap, you agree to be bound by these Terms. "Using the Application" includes creating an account, logging in, creating student profiles, generating content, editing or downloading content, and interacting with any features of the Application on the web or in the iOS app.

If you do not agree to these Terms, you must not access or use the Application. By using the Application after being presented with these Terms, you acknowledge that you have read, understood, and agree to be bound by them.

We may revise these Terms from time to time. The most current version will always be posted on this page. If a revision is material, we will notify you via the email address associated with your account. By continuing to use the Application after revisions become effective, you agree to be bound by the revised Terms.

These Terms are governed by the laws of the State of Missouri and applicable federal laws of the United States of America.
